Shmuel Galinka, Amir Fisher, and Gal Rabinovich represented Arad Measuring Technologies Ltd in a lawsuit in the Tel Aviv District Court against four defendants from Brazil – a company that purchased from Arad water meters and three of its managers.
The lawsuit claims that the company purchased from Arad products in the total amount of 2.2 Million USD and did not pay. The Brazilian defendants submitted a request to dismiss the lawsuit, claiming that the jurisdiction to hear the case is in Brazil. After a hearing that included witness examination through Zoom, the court determined that the jurisdiction to hear the case is in the Israeli court.
At this point, the Israeli attorneys representing the defendants resigned. The defendants did not comply with the court’s decisions regarding preliminary proceedings and did not appear for the initial pre-trial hearing. The court granted Arad’s request and rendered a judgment in favor of Arad for the full amount of the claim – approximately 10.5 million NIS.
