Representating leading attorneys – petition against extensioning the Acting State Prosecutor’s appointment

Partners Joseph Benkel & Nati Agmon, associate Lidar Kupershmidt-Tal and inten Yam Itzhaky represented leading attorneys in the law industry in a petition to the High Court of Justice against the Minister of Justice’s intention to extend the temporary appointment of the Acting State Prosecutor, despite the fact that this was an appointment made at the end of the tenure of a provisional government, and despite the Attorney General’s stand in this matter. The Supreme Court upheld the requested interim order, pausing the appointment of the Acting State Prosecutor.

In the petition it was argued that the extension of the appointment of the Acting State Prosecutor by a Minister of Justice appointed by a provisional government is exceptional rare, especially when it’s in contrary to the Attorney General’s stand and despite the fierce criticism on the functioning of the Acting State Prosecutor during his officiating – is an extremely unreasonable decision. It was also argued that under the circumstances, a underhanded opportunism should not be allowed in the appointment of such a senior and sensitive position in the law enforcement system, and it is required to “take the high-road” of selecting a permanent State Prosecutor by using a Judicial Selection Committee that will be led by the Attorney General, after a new Minister of Justice will strat to serve in the position. The petition recieved high media coverage.
