Dror Harpaz and Shai Sarig successfully represented Sociedad Española de Montajes Industriales S.A. (“SEMI”), the electrification contractor for Israel Railways, in a NIS 3,320,000 claim filed against it by D.A.I. Logic Ltd. and others, alleging breach of contract and damages caused as a result of that breach.
The Tel Aviv District Court (Judge Tal Levy-Michaeli) accepted our arguments and dismissed the claim in its entirety, while ordering the plaintiffs to pay SEMI its full legal costs in the amount of NIS 353,465.
What is notable about this case is that the court ordered the plaintiffs to pay SEMI its full legal costs. This is a rare outcome, which may reflect a welcome shift in the courts’ approach to ensuring that a party who prevails in litigation does not emerge from the proceedings having suffered a financial loss.
