A significant achievement for our Litigation team: the Central District Court (Lod) has fully accepted our motion to dismiss a request for certification of a class action against Mifal Hapayis.
The claim alleged that the placement of lottery booths in public spaces constitutes a nuisance and is carried out without legal basis. At the core of the case was the question of whether the presence of business infrastructure on city sidewalks creates a “business–customer” relationship with passersby and residents.
The Court adopted our position, ruling that the general public cannot be considered “customers” of Mifal Hapayis in this context, and that no direct legal relationship exists to support a class action. Accordingly, the motion was dismissed outright, with costs awarded in favor of Mifal Hapayis.
Mifal Hapayis was represented by partner Nati Agmon and Adv. Roni Mor Yosef from Shibolet’s Litigation Department.
