Attorneys Dror Harpaz, Lidar Kupershmidt-Tal, and Nitzan Harel successfully represented Ashdod Port Company Ltd. (Respondent 1) in an administrative petition filed by Avraham Shrizli & Son Ltd. (the Petitioner) challenging a decision of the Port’s Tender Committee.
The case centered on the interpretation of a threshold requirement in an international public tender for the supply and maintenance of lifting jacks. The Petitioner claimed that the bid selected as the winner did not meet the threshold requirements and that its own bid had been wrongfully disqualified.
On behalf of Ashdod Port, we argued, inter alia, based on an engineering expert opinion, that the Tender Committee’s decision to disqualify the Petitioner’s bid was proper, that the winning bid fully complied with the tender requirements, and that the Petitioner’s interpretation of the tender conditions was incorrect and inconsistent with the relevant professional standards.
The District Court (Hon. Judge Eli Brand) fully accepted our position, holding that our interpretation of the threshold requirements, supported by expert opinion, was correct. The Court further emphasized that judicial intervention in professional tender committee decisions is limited and found no flaw in the Committee’s decision.
Accordingly, the petition was dismissed in full, and the Petitioner was ordered to pay Ashdod Port legal costs in the amount of NIS 30,000 plus VAT.
